UPDATE: Mr. Brafman “Opened The Door” Last Night… “The Truth Will Always Be Far Stranger…”

We are presently awaiting reliable word on what Mr. Hassan was asked — on direct — but I would bet it included confirming the testimony of his daughter, of yesterday.

That testimony said that Mr. Shkreli was throwing the elder Mr. Hassan’s name around, to try and woo investors in Mr. Shkreli’s various ventures — and was doing so with a knowing (mens re) falsity. That, I bet is what he’s here to confirm — since Mr. Brafman so helpfully opened the door (for the prosecution), by berating the witness yesterday, on truthfulness, among other matters.

Meanwhile, Mr. Shkreli took the lunch break to berate the press pool, in the overflow room — calling the Eastern District of NY US Attorney’s Office the “Junior Varsity” team… before Mr. Brafman could drag him away. Charming.

Condor opines: That would be because it is likely that the only offer was… “here’s an orange jumpsuit…. Go do 20. That’s our firm and final deal/offer.” Heh.

      I can’t believe he thinks people are that stupid…….but he’s right about the media. They still haven’t caught on that it is martin. And you can tell it is martin because how fixated he is on people who are critical on him as a businessman.

      You can also tell because there is video footage of him typing on twitter under Blmbro. lol 🙂

      Btw, can we talk about how tasteless it is to joke about black lives matter movement with his screen name? I think people don’t get that the movement itself is to bring awareness that Black life is worth any life in our nation. It has nothing to do with “But what about me? You think your special? I have people dying,too ” There is no insult to any other community, it has to do with the fact of the negligence & disregard of that section of society. That’s why the movement exists.

      More than ethically — this is the crux of the government’s case.

      Marty treated everything as though it was his own piggy bank. It’s a classic case. Those assets were “under management” — not his personally. He had fiduciary duties to these investors. Almost to a certainty, he breached those legal fiduciary duties.

      And… we will learn in coming weeks, that in at least one case, he simply gave investors a disclosure document for ANOTHER fund, with the names changed (by Marty) — and then told them a reputable law firm had prepared it.

      That firm says Shkreli stole its work product form the prior fund, made inaccurate (and damaging, to investor interests) changes, and then claimed it was the reputable law firm’s own work.

      Marty doesn’t even know enough to tell plausible lies — which is what Fast Fred meant when he called him a “homework guy” — not very knowledgeable.

    Having a hard time following Brafman’s cross of Fred Hassan. What’s the point here? To show that Hassan knew he was on $RTRX board and is lying about it now? And/or to show that Hassan, through his daughter, “invested” in $RTRX via shares given to daughter by Shkreli in lieu of MSMB cash? If either, it seems a long, circuitous way to go to establish some connection between Fred Hassan and Shkreli that might not really matter in the end or, most important, to the jury.

      I agree Doc… This defense seems to be quite thin so far. For the “High Powered” reputation Brafman had, I’m a little let down that he’s not making more sense. Maybe he’s playing defense on something the Govt might hit him with later. Re: claims of F. Hassan being an RTRX investor/board member.

      He’s trying to “make true” — years after the fact — that Mr. Shkreli didn’t outright lie when he repeatedly claim Fred Hassan was an investor of his.

      But yesterday, Sarah Hassan said she had to repeatedly remind Martin that this was her fund — she’s an adult, savvy hedge fund manager — and not her father’s.

      Of course — Fast Fred’s is the more widely known name. So Mr. Shkreli’s motive to fabricate, especially when he was running on vapor in both of his own hedge funds… is obvious.

      I strongly suspect that Mr. Hassan’s direct testimony (though we don’t have it yet), for the prosecution — was largely to confirm the deceptions his daughter described, all as made by/about Martin…

        But why is that a bigger issue than doctoring statements etc.? Also, why are they trying to say Marty “rolled over” S. Hassan’s investment into MSMB Capital without her permission to fund the RTRX startup? Is that any better legally than what actually happened? (i.e. He lied and told her the $300,000 had grown to $430,000… when it was actually gone. {poof})

        Is she really Condor? A savvy hedge fund manager? She invested money with Martin Freakin’ Shkreli 🙂 and did little to no background investigation… Or she would have notice the prior fund bust. Wouldn’t she have?

        The whole Fred Hassan angle seems like a Shkreli-fueled personal vendetta that’s really off-point from the trial and indictments. But maybe I’m missing something. Even if there were a relationship, who cares? Why would that be germane to Shkreli’s overall defense, other than for Shkreli to say that he wasn’t lying about Fred Hassan being on $RTRX board?

        It appears that Brafman is testing the judge’s patience today:

        All of this is right, Doc & Billy… and we are on day two of five weeks… the government will get to the false statements of account … in time.

        In my opinion, Mr. Brafman made a tactical error by attacking Sarah Hassan’s veracity… it opened the door to Fred being called as backup… and still I am curious to see what Fred said — on direct.

        I am pretty sure the AUSAs hadn’t planned on calling him.

        And Billy, you know that I do think Fred is ethically “challenged” — but I suspect he’s told the truth here.

        As to Sarah… I have only press reports, to go on. I’ve met dad several times, but not daughter. Neither know who I am, in real life, to be sure.

        Nope. But to be clear, I don’t care about the guy one way, or the other — I’ve been across the table from him, representing other people/companies in buying or selling life science companies… and he’s just sort of a higher priced (and older) version… of Marty.

        Sad but true — he’s the Augusta Country Club version of Marty’s public Rucker Park swimming pool…

        Ok, reread your post, condor. So the allegation is that Shkreli used Fred Hassan’s name to lure investors (either in MSMB or $RTRX or both–?) without Fred’s permission–even though Fred’s daughter did invest with Shkreli, first through MSMB and then through $RTRX (the latter against her initial wishes).

        The allegation is that Shkreli is a name-dropping con man. Fred Hassan was neither on the board of $RTRX (despite Shkreli posting him on $RTRX’s website as being on the board), nor did Fred passively or actively invest with Shkreli vis-a-vis his daughter’s investments.

        Do I have that right now?

        Yes — and Mr. Shkreli had repeatedly said Brent Saunders was “on his Retrophin board.” Mr. Saunders flatly denied it many times, over the years. Shkreli says it was a paperwork confusion. That is facially preposterous — (but Marty thinks it a plausible lie). Retrophin was by then a public company; SEC proxy rules and NASDAQ listing rules require quite a bit, including a signed written consent from the putative director candidate, in order to even nominate them for a public company board, let alone elect them. He’s a sociopath.

        Saunders is likely to be called next week to say that was ALSO a lie.

        I don’t honestly know. We will know when the prosecution tells us, in court. If he was, you may reliably bet he got the Sarah Hassan “special treatment, extra gravy” returns. More fraud (allegedly).

        I have a personal hunch the the “man of the high forehead” (as he’s occasionally called, behind his back)… never put his own cash in.

        But I have no proof of it.

        What was the point of trying to take S. Hassan out of the “victim column” yesterday? Of course Shkreli scrambled to steal from someone else to pay her back and then some. He didn’t want to piss off her dad. It’s not like their weren’t others who lost their asses and didn’t get paid back. (Like today’s earlier witness)

    This is pointless the way this trial is documented. They should give us a audio stream that is prerecorded a hour before if they dont want to do it livetime. We should all witness things

    BOOM! Exactly what I’ve been saying the whole time! Marty’s fragile ego won’t let him admit that he’s the WORST HEDGE FUND MANAGER IN HISTORY… I’m glad the prosecution is laying out chapter and verse. These also have to be tough facts to hear for his supporters who seized on the fact that Ms. Hassan got all her money back plus some… Marty over compensated with her because of who her Daddy is! But now Daddy is in the stand!
