I know Mr. Brafman will — so the government may need to do so — just to show they really believed 15 was the just number, based on prior Second Circuit precedents…

What the expert court consultants will tell you is, since Marty is coming from prison in his jump suit, it’s going to be easier for the Judge to give him a harsher sentence. If he showed up from home (as would have been the original plan) in some nice business clothes, his chances would be better. Granted, a judge is not a jury, but the Judge has to deal with the court of public opinion … and the news media will have some drawings of Marty in his jumpsuit … so it’s like the Judge is starting out on first base already!
As a technical matter (for debating purposes), I’m not sure that the crimes merge and 20 is the max. sentence, as some have indicated … since the different crimes had different victims. Probably more of a theoretical issue, since unlikely Judge would go beyond 20 in any event… but we like to debate these things!.
There’s still going to be a couple of years of appeals, regardless. So there will be more issues ahead … except appeals could drag on … more like playing chess by regular U.S. mail!
As far as I know, NYU never returned Shkreli’s money, which established the endowed professorship at NYU. (The amount was never revealed, but it was likely in the millions.) Nevertheless, it appears that Dr. Trachtman has scrubbed Martin Shkreli’s name from his webpage. Dr. Trachtman is no longer publicly identified as the “Martin Shkreli Professor of Pediatric Nephrology” at the NYU website. And the doctor certainly didn’t identify himself as such when signing his letter of support for Shkreli.

I figured the judge would do half of what the Govt asks or 7.5 and they adjust up or down by 6 months depending on the arguments of the lawyers.
Shkreli has an A+ lawyer, so 7 was a good number.
But it was too close to R West’s 7.5, so I picked 6.5

NOW — as if to prove there is always a wrinkle, with this guy — and this case — Mr. Brafamn JUST NOW FILED (10:30 EST on the eve of sentencing) one MORE very tardy letter of support — from a medical researcher/MD who once worked with Marty. It’s a nice letter — but is likely meaningless.

The letter is from Howard Trachtman, a nephrologist who once held (and perhaps still does) an endowed, NAMED professorship at NYU.
And the name on that endowed professorship?
Yup, you guessed it. None other than Martin Shkreli.

Fascinating. Professor Coffee is a very smart guy. He thinks “no way” will Judge Matsumoto pull a 20 or more. Me? I’m not so sure.
It seems some of the letters authored by the guy who wrote the article, and Marty’s replies, may also have been part of the AUSAs’ filing this week.
