Plaintiff – Grant Lally; Defendant Martin Shkreli (“Shkreli”) – John Wait (“Wait”), Alexandra Sobol (“Sobol”).
Plaintiff contends that Wait and Sobol, despite stating that they represent not only Shkreli but also Defendant Turing Pharmaceuticals, LLC (“Turing LLC”), cannot serve as attorneys for both parties because of a conflict of interest. Accordingly, the Court stayed motion practice for the dismissal motion.
In light of Plaintiff’s representations, the Court at the conference granted him leave to file a motion to disqualify Wait and Sobol as counsel for Turing LLC. As stated on the record, Plaintiff shall serve his initial brief no later than May 30, 2018. Wait and Sobol shall file their opposition brief no later than June 27, 2018. Plaintiff shall serve his reply brief no later than July 12, 2018. The motion papers shall be filed on ECF no later than July 12, 2018.
Finally, Plaintiff voluntarily dismisses without prejudice his claims against Defendant Turing Pharmaceuticals AG (“Turing AG”) because he has failed properly to serve process on Turing AG. The Court therefore respectfully DIRECTS the Clerk of Court to terminate Turing AG as a party in this action.
